1. Introduction

Welcome to Dynamic Decks. These Terms of Service ("Terms") govern your use of our services and website. By engaging with our services or accessing our website, you agree to comply with and be bound by these Terms.

2. Services Provided

Dynamic Decks specializes in the design, construction, and maintenance of custom decks in Utah. Our services are tailored to meet the unique needs of each client, ensuring quality craftsmanship and customer satisfaction.

3. Definitions

Client: The individual or entity engaging Dynamic Decks for services.

Contractor: Dynamic Decks, including its employees, agents, and subcontractors.

Services: All tasks and responsibilities undertaken by Dynamic Decks as outlined in the agreed-upon contract.

4. Independent Contractor Status

Dynamic Decks operates as an independent contractor. Nothing in these Terms or any contract shall be construed to create an employer-employee relationship between Dynamic Decks and the Client. As an independent contractor, Dynamic Decks maintains control over the methods and means of providing the agreed-upon services.

5. Licensing and Compliance

Dynamic Decks is fully licensed and insured to operate in the state of Utah. We comply with all local, state, and federal regulations, including obtaining necessary permits for construction projects. Clients are responsible for ensuring that their project complies with any homeowners association guidelines or other local regulations.

6. Project Estimates and Payments

Estimates: Upon request, Dynamic Decks will provide a detailed written estimate outlining the scope of work, materials, costs, and projected timelines.

Payments: Payment schedules will be outlined in the contract. A deposit may be required before commencement of work, with the remaining balance due upon completion, unless otherwise specified.

Late Payments: Invoices not paid within the agreed-upon timeframe may incur interest charges as specified in the contract.

7. Changes and Modifications

Any changes to the original scope of work must be documented in a written change order, detailing the modifications and any associated costs. Both parties must agree to and sign the change order before additional work commences.

8. Warranties and Liabilities

Warranties: Dynamic Decks warrants that all work will be performed in a professional manner and in accordance with industry standards. Specific warranty details will be provided in the contract.

Liabilities: Dynamic Decks carries general liability insurance as required by Utah law. Clients are responsible for maintaining adequate property insurance during the project.

9. Termination

Either party may terminate the contract with written notice if the other party breaches any material term of the agreement and fails to remedy the breach within a specified timeframe. Upon termination, the Client agrees to pay for all services rendered and materials purchased up to the termination date.

10. Governing Law

These Terms and any associated contracts are governed by the laws of the State of Utah. Any disputes arising from these Terms or related services shall be resolved in the courts of Utah County, Utah.

11. Dispute Resolution

In the event of a dispute, both parties agree to attempt mediation before pursuing legal action. If mediation fails, the dispute shall be resolved through binding arbitration in accordance with Utah state laws.

12. Confidentiality

Dynamic Decks respects client privacy and agrees to keep all personal and project-related information confidential, except as required by law or necessary to perform the contracted services.

13. Force Majeure

Dynamic Decks shall not be liable for delays or failures in performance resulting from events beyond its reasonable control, including but not limited to natural disasters, acts of government, or labor disputes.

14. Entire Agreement

These Terms, along with any written contract, constitute the entire agreement between Dynamic Decks and the Client, superseding all prior agreements or understandings, whether written or oral.
